OVERVIEW

This website is operated by ValenSparks LLC, doing business as Work Bestie (“Work Bestie,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of heyworkbestie.com, shop.heyworkbestie.com, related Work Bestie webpages, products, digital products, courses, personalized sessions, consulting services, AI Work Bestie Business Intensives, workshops, programs, and other services or resources we provide (collectively, the “Services”).

By accessing our websites, purchasing a product or Service, booking a session, registering for a program, or otherwise using our Services, you agree to these Terms and any additional policies or terms referenced here, including our Privacy Policy.

If you do not agree to these Terms, please do not use the Services.

SECTION 1 — ELIGIBILITY AND ACCEPTABLE USE

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or have appropriate permission to use the Services.

You may not use our Services for any unlawful or unauthorized purpose or in violation of applicable laws or the rights of Work Bestie or any third party.

You may not transmit viruses, malicious code, or other material intended to disrupt or interfere with our websites, Services, systems, or users.

We reserve the right to refuse or discontinue Services where reasonably necessary, including in cases of misuse, unlawful conduct, harassment, nonpayment, violation of these Terms, or conduct that interferes with our ability to provide Services safely and effectively.

SECTION 2 — OUR SERVICES

Work Bestie provides products and Services that may include:

* Personalized AI learning and support sessions
* AI Work Bestie Business Intensives
* AI education and consulting
* Workshops, programs, cohorts, speaking, and facilitation
* Courses, guides, templates, prompts, and digital resources
* Physical merchandise
* Other educational, consulting, or business resources

The specific scope, format, duration, price, and deliverables for a Service may be described on the applicable sales page, booking page, proposal, invoice, agreement, or other written communication.

If there is a conflict between these general Terms and a separately signed agreement governing a particular engagement, the separately signed agreement will control for that engagement.

SECTION 3 — AI EDUCATION, CONSULTING, AND BUSINESS INTENSIVES

Work Bestie provides AI education, strategy, guidance, practical recommendations, and hands-on working support based on the information you provide and the scope of the Service purchased.

For services such as the AI Work Bestie Business Intensive, our work may include reviewing workflows, processes, repetitive tasks, business practices, tools, or other areas of work; identifying potential AI opportunities; prioritizing opportunities; recommending approaches or tools; and beginning to develop selected solutions with you.

Unless specifically agreed otherwise in writing, Work Bestie does not provide software development, custom software engineering, IT administration, cybersecurity services, or ongoing technical implementation or management.

A session or engagement may identify more opportunities than can reasonably be addressed during the time purchased. Work Bestie does not guarantee that every opportunity, workflow, project, recommendation, or solution identified during an engagement will be completed during that engagement.

Any follow-up work outside the purchased scope may require an additional Service or separate agreement.

SECTION 4 — CLIENT RESPONSIBILITIES

You are responsible for providing information that is reasonably accurate and complete so that Work Bestie can provide the Services you purchase.

You remain responsible for all decisions concerning your business, work, systems, employees, customers, clients, data, and use of recommendations provided through Work Bestie.

You are responsible for reviewing, testing, approving, and implementing any strategy, workflow, prompt, AI output, recommendation, or other material before relying upon or using it.

You agree not to provide passwords or information you are not authorized to share.

You are also responsible for determining whether confidential, proprietary, personal, customer, client, employee, or other sensitive information may appropriately be shared with Work Bestie or entered into any third-party platform.

SECTION 5 — ARTIFICIAL INTELLIGENCE AND THIRD-PARTY AI TOOLS

Work Bestie uses and teaches third-party artificial intelligence tools, which may include ChatGPT, Claude, Gemini, and other AI-enabled platforms.

AI tools may be used in connection with brainstorming, research, analysis, workflow development, drafting, educational materials, recommendations, client deliverables, or other aspects of our Services.

Artificial intelligence can produce inaccurate, incomplete, biased, outdated, or unexpected results. AI-generated information should not automatically be treated as verified fact or professional advice.

Third-party AI platforms operate independently of Work Bestie and are governed by their own terms, privacy policies, security practices, availability, features, and pricing. Work Bestie does not control or guarantee those platforms.

Information provided to Work Bestie may be processed using third-party AI tools when reasonably necessary to provide the Services requested, as further described in our Privacy Policy.

You remain responsible for reviewing and determining whether AI-assisted recommendations or outputs are appropriate for your particular circumstances.

SECTION 6 — THIRD-PARTY TOOLS AND SERVICES

Our Services may use, integrate with, recommend, or link to third-party platforms, products, websites, applications, or services.

Third-party services are provided according to their own terms and policies. Work Bestie does not control and is not responsible for the availability, performance, pricing, security, privacy practices, accuracy, or actions of independent third parties.

You are responsible for reviewing applicable third-party terms before using those services.

Work Bestie may occasionally recommend products or services through affiliate relationships and may receive compensation if you make a purchase through certain links. Where required, applicable affiliate relationships will be disclosed.

SECTION 7 — SESSION RECORDING AND TRANSCRIPTION

Certain Work Bestie sessions, meetings, workshops, or programs may be recorded or transcribed.

When recording or transcription is used, Work Bestie will provide notice or request consent as appropriate before or at the beginning of the session.

Recordings and transcripts may be used to provide Services, prepare follow-up materials or deliverables, maintain appropriate business records, or for other purposes disclosed to you.

If you do not wish to participate in a recorded or transcribed session, please notify Work Bestie before recording begins so we can determine whether an alternative is available.

Our handling of recordings, transcripts, and personal information is further described in our Privacy Policy.

SECTION 8 — CLIENT MATERIALS AND CONFIDENTIAL INFORMATION

You may choose to provide Work Bestie with documents, workflows, templates, screenshots, spreadsheets, presentations, business information, or other materials in connection with the Services (“Client Materials”).

You retain ownership of your Client Materials.

You grant Work Bestie permission to access, review, process, and use Client Materials as reasonably necessary to provide the Services you requested.

Work Bestie will not intentionally publish your private Client Materials as public-facing content or marketing materials without your permission.

You represent that you have the right and authority to provide any Client Materials you submit and that doing so does not violate the rights of another person or organization.

Please do not provide passwords or unnecessary sensitive personal information, confidential third-party information, or information you are not authorized to share.

SECTION 9 — WORK BESTIE INTELLECTUAL PROPERTY

Work Bestie retains all right, title, and interest in its original intellectual property, including its frameworks, methodologies, processes, worksheets, templates, prompts, guides, presentations, course materials, workshop materials, AI Work Bestie Blueprints, designs, written content, training materials, and other proprietary resources (“Work Bestie Materials”).

Unless otherwise stated in writing, purchasing a Service does not transfer ownership of Work Bestie Materials to you.

You are granted a limited, non-exclusive, non-transferable license to use Work Bestie Materials provided to you for your own personal or internal business purposes.

You may not, without prior written permission:

Resell or redistribute Work Bestie Materials
Publish or publicly distribute them
Share purchased materials with unauthorized third parties
License or sublicense them
Reproduce them for commercial distribution
Use them to create, teach, market, or sell a competing product, program, training, or service
Remove copyright, trademark, or proprietary notices

Nothing in these Terms prevents you from using your own ideas, business information, Client Materials, or general knowledge gained through participation in the Services.

SECTION 10 — DIGITAL PRODUCTS

When you purchase a Work Bestie digital product, course, guide, template, prompt pack, or similar resource, you receive a limited, non-exclusive, non-transferable, non-sublicensable license to use that product for the purposes stated at purchase.

Unless expressly permitted, digital products may not be copied, reproduced, redistributed, shared, resold, published, transmitted, or used to create competing commercial products or services.

Access to certain digital products or platforms may be limited in duration if disclosed at the time of purchase.

Digital products are non-refundable except where otherwise required by law or expressly stated in writing.

SECTION 11 — PHYSICAL PRODUCTS

Physical products purchased through Work Bestie are subject to the descriptions, pricing, shipping information, and policies presented through our online store.

We make reasonable efforts to display products accurately, but colors and appearance may vary based on devices and displays.

Custom physical products are generally not eligible for returns, exchanges, or cancellations except in cases of manufacturing defects or as otherwise required by law.

Additional return or refund terms may be provided at checkout or through our applicable Refund and Return Policy.

SECTION 12 — PRICING, PAYMENT, AND BILLING

Prices are displayed at the time of purchase or provided through a proposal, invoice, or written agreement.

Prices may change at any time, but a price change will not ordinarily affect a purchase already completed unless otherwise disclosed or agreed.

Payment for sessions and Services is due according to the terms presented during booking, checkout, invoicing, or contracting.

You agree to provide accurate and current billing and contact information.

Payments may be processed through third-party providers such as Stripe, PayPal, Shopify, or other payment processors. Work Bestie does not control the independent practices of those providers.

SECTION 13 — SCHEDULING, RESCHEDULING, CANCELLATIONS, AND NO-SHOWS

Purchasing or booking a session reserves dedicated time and, in some cases, preparation time for your engagement.

For Personalized AI Learning Sessions and AI Work Bestie Business Intensives:

Payment is due at the time of booking unless otherwise stated.
You may reschedule your appointment one time when you provide at least 48 hours’ notice before the scheduled start time.
Rescheduling requests made with less than 48 hours’ notice may be treated as a late cancellation.
Cancellations made with less than 48 hours’ notice and no-shows are non-refundable.
After the one permitted reschedule, additional rescheduling requests may require a new booking or additional payment.
If you arrive late, the session will ordinarily still end at the originally scheduled time. Missed time is not guaranteed to be extended or refunded.
Work Bestie may make reasonable exceptions in its discretion for emergencies or extraordinary circumstances.
If Work Bestie needs to reschedule a session, we will work with you to identify a new date and your permitted client-initiated reschedule will not be affected.

Unless a different period is stated when purchasing, prepaid individual sessions and Business Intensives must be scheduled and used within six months of purchase.

Organizational workshops, programs, speaking engagements, cohorts, or other custom engagements may have separate cancellation, rescheduling, payment, travel, or termination provisions provided in the applicable proposal or agreement.

SECTION 14 — REFUNDS

Except as expressly provided in these Terms, at checkout, in an applicable Refund and Return Policy, or in a separate written agreement:

Digital products are non-refundable.
Completed Services and time already provided are non-refundable.
No-shows and cancellations made with less than 48 hours’ notice for scheduled individual Services are non-refundable.
Physical products are subject to the applicable return/refund provisions described above and at purchase.

Nothing in this section limits any refund or remedy that cannot legally be waived.

SECTION 15 — WORKSHOPS, PROGRAMS, AND ORGANIZATIONAL ENGAGEMENTS

Workshops, programs, cohorts, speaking engagements, facilitation, and other organizational Services may be customized based on the audience, objectives, format, location, number of participants, and scope.

The specific scope, deliverables, fees, payment schedule, travel arrangements, cancellation provisions, intellectual property permissions, recording permissions, and other engagement-specific terms may be provided in a separate proposal, statement of work, invoice, or agreement.

Acceptance of a proposal or payment of an invoice may constitute acceptance of the applicable engagement terms where permitted by law.

SECTION 16 — TESTIMONIALS, REVIEWS, AND PUBLIC FEEDBACK

If you voluntarily submit a review, testimonial, comment, or other feedback for potential public use, Work Bestie may request permission to use that content for marketing, promotional, or informational purposes.

Where permission is granted, we may edit the content for length, grammar, formatting, or clarity without materially changing its meaning.

Private Client Materials, intake responses, session recordings, and confidential business information are not treated as public testimonials or feedback merely because you provided them to Work Bestie.

SECTION 17 — EDUCATIONAL PURPOSE AND PROFESSIONAL ADVICE

Work Bestie Services are educational and consultative in nature.

Information, strategies, AI guidance, recommendations, materials, and other Services provided by Work Bestie do not constitute legal, financial, tax, medical, cybersecurity, accounting, or other licensed professional advice.

You should consult an appropriately qualified professional when specialized professional advice is required.

SECTION 18 — NO GUARANTEE OF RESULTS

Work Bestie does not guarantee any specific business, financial, career, productivity, efficiency, revenue, cost-savings, AI, or other outcome from using our products or Services.

Results depend on many factors outside Work Bestie’s control, including your circumstances, implementation, decisions, technology, third-party platforms, market conditions, and other factors.

Testimonials, examples, case studies, or descriptions of prior results do not guarantee that you will achieve the same or similar results.

SECTION 19 — WEBSITE INFORMATION AND AVAILABILITY

We make reasonable efforts to provide accurate and current information but do not guarantee that all website content, pricing, descriptions, availability, or other information will always be complete, accurate, or current.

We may correct errors, update information, modify offerings, change prices, or discontinue products or Services at any time, subject to applicable law and existing contractual commitments.

We do not guarantee that our websites, online store, digital platforms, or third-party services will always be available, uninterrupted, secure, or error-free.

SECTION 20 — PROHIBITED USES

You may not use our websites, products, Services, or materials:

For unlawful or fraudulent purposes
To violate applicable laws or regulations
To infringe intellectual property, privacy, publicity, or other rights
To harass, threaten, abuse, or harm others
To transmit malicious code
To scrape, copy, reproduce, or commercially exploit Work Bestie content without authorization
To attempt unauthorized access to systems or accounts
To submit information you do not have the right to provide
To misrepresent your identity or affiliation
To interfere with the security or operation of our Services

We may suspend or terminate access for violations of these Terms.

SECTION 21 — DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, our websites, products, materials, and Services are provided on an “as is” and “as available” basis except where expressly stated otherwise.

Work Bestie does not warrant that the Services will be uninterrupted, error-free, completely secure, or suitable for every particular purpose.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

SECTION 22 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Work Bestie and ValenSparks LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, or loss of data, arising from or relating to your use of our Services.

To the maximum extent permitted by law, Work Bestie’s total liability arising from a particular product or Service will not exceed the amount you paid Work Bestie for the product or Service giving rise to the claim.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

SECTION 23 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless ValenSparks LLC d/b/a Work Bestie and its owners, officers, employees, contractors, agents, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from your violation of these Terms, your unlawful use of the Services, your violation of another party’s rights, or materials you provide without appropriate authorization.

SECTION 24 — PRIVACY

Our collection, use, and disclosure of personal information are governed by our Privacy Policy.

Please review the Privacy Policy for information regarding our use of cookies, analytics, advertising technologies, AI tools, session recordings and transcriptions, third-party providers, and other data practices.

SECTION 25 — TERMINATION

We may suspend or terminate access to Services where reasonably necessary because of a violation of these Terms, unlawful activity, nonpayment, abuse, harassment, security concerns, or misuse of our Services or intellectual property.

Terms that by their nature should survive termination, including intellectual property, payment obligations, disclaimers, limitations of liability, and other applicable provisions, will survive termination.

SECTION 26 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

SECTION 27 — WAIVER

Failure by Work Bestie to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

SECTION 28 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, applicable purchase policies, and any proposal, agreement, or other terms governing a particular Service, constitute the agreement between you and Work Bestie concerning the applicable Services.

SECTION 29 — GOVERNING LAW

These Terms and any separate agreements through which Work Bestie provides Services will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

SECTION 30 — CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our Services, business practices, technology, or legal requirements.

The current version will be posted on our website with an updated “Last Updated” date.

Changes will apply prospectively unless otherwise permitted or required by law.
